Small Business Health Coverage in Texas: What Owners With 2 to 50 Employees Should Know First
Health coverage comes up in every hiring conversation, usually right after pay. For a Texas business with a handful of employees, group coverage can be the difference between keeping a great hire and losing them to a bigger company. Here is how the small group market works in Texas, in plain English, before you talk to anyone.
Who counts as a small employer in Texas
Under Texas law, a small employer is a business with 2 to 50 employees, and the market is overseen by the Texas Department of Insurance (TDI). Eligible employees are generally those working at least 30 hours a week.
Coverage in this market is guaranteed issue: carriers cannot turn your business away or exclude your employees' health conditions. An independent brokerage compares across insurers instead of showing you one company's menu. That matters because networks and drug formularies differ a lot between carriers, and the right fit depends on your team's actual doctors.
The two numbers that decide your options
Participation. Most carriers require around 75 percent of your eligible employees to enroll, though employees covered elsewhere, through a spouse's plan or the VA for example, generally do not count against you.
Contribution. Employers typically cover at least 50 percent of the employee premium. What you contribute beyond the minimum is a recruiting decision as much as a benefits one: it is the number your people actually feel in their paychecks.
Timing, taxes, and where to shop
Timing helps too. Group coverage has its own enrollment rules, and starting the conversation a couple of months before you want coverage live avoids a rushed decision. Employers generally enroll through a broker or directly with carriers; the federal SHOP marketplace at HealthCare.gov also serves Texas employers.
Very small employers may also qualify for the federal Small Business Health Care Tax Credit, worth up to 50 percent of premium costs for eligible employers who buy through SHOP. It is narrow, mainly businesses under 25 full-time-equivalent employees paying modest average wages, but worth checking before you assume it is not for you.
